Privacy Policy

The Service is operated by BlackYack SUARL, a Tunisian single-member limited liability company (société unipersonnelle à responsabilité limitée) registered with the Registre National des Entreprises (RNE) under unique identifier 1730839M, with its registered office at Avenue Hédi Nouira, 5000 Monastir, Tunisia (operating under the brand “Artwelt”; “BlackYack”, “we”, “us”). BlackYack is the controller responsible for your personal data.

Account information

When you create an account, our authentication provider Clerk processes identifiers such as your name, email address, and authentication credentials on our behalf. We do not store your password.

Payment information

When you purchase credits or a plan, our payment processor Konnect collects and processes your billing details and card data. We do not store full card numbers; we retain only limited records such as transaction identifiers, plan, and credit balance.

Content you provide

• Prompts and instructions you enter to generate or edit media.
• Uploaded images and other files you submit for editing or as references.
• Generated media — the images and videos produced by the Service.

Usage and technical data

We collect data about how you use the Service, such as feature usage, credit consumption, device and browser information, IP address, and log data, to operate, secure, and improve the Service.

We process personal data in accordance with Organic Law No. 2004-63 of 27 July 2004 on the protection of personal data, on the following grounds:

• Performing our contract — to create and manage your account, process your prompts and uploads, generate and store your media, and handle billing.
• Your consent — for optional cookies and analytics, and any optional use of your content beyond delivering the Service. You may withdraw consent at any time.
• Our legitimate interests — to secure the Service, prevent abuse and fraud, debug, and improve our product, where these interests are not overridden by your rights.
• Legal obligations — to meet accounting, tax, and other legal requirements.

We share personal data only with the service providers needed to run Artwelt, each acting as a processor under contract. These are:

• Clerk — authentication and account management.
• Konnect — payment processing (card, e-DINAR, wallet).
• Alibaba Cloud Model Studio (Singapore) — AI image and video generation.
• Replicate (USA) — AI model hosting.
• Microsoft Azure (EU, West Europe) — application hosting, database, and media storage.

A full, current list is maintained on our Sub-processors page. We do not sell your personal data.

Your account, database, and stored media are hosted on Microsoft Azure (European Union, West Europe region). To generate media, your prompts and uploaded images are sent to AI providers located outside Tunisia:

• Alibaba Cloud Model Studio — Singapore.
• Replicate — United States.

Because these providers and our hosting are located outside Tunisia, your personal data is transferred abroad. Such transfers are carried out in accordance with Organic Law No. 2004-63, which regulates the transfer of personal data outside Tunisia and may require authorization from the Instance Nationale de Protection des Données à caractère Personnel (INPDP). We put appropriate contractual safeguards in place with each provider. You may request information about these safeguards at privacy@artwelt.app.

Generated and uploaded media are kept in private Azure Blob storage, protected by role-based access control (RBAC) and served only through short-lived signed URLs. Access to personal data is restricted to authorized personnel on a need-to-know basis.

We retain your account data for as long as your account is active. Prompts, uploads, and generated media are retained for the duration of your use of the Service and are removed by our automated retention purge job in line with our retention schedule, or sooner upon your request. When you delete your account, all stored media is erased. Limited records required for legal, tax, or fraud-prevention purposes may be retained for the period required by law.

Subject to applicable law, you have the right to: access your data; rectify inaccurate data; erase your data; receive your data in a portable format; object to or restrict certain processing; and withdraw consent at any time without affecting prior processing.

You can exercise the core rights directly in the product:

• Export my data — download a copy of your personal data and content from your account settings (portability and access).
• Delete account — permanently close your account and erase all stored media (erasure).

For any other request, contact privacy@artwelt.app. You also have the right to lodge a complaint with the Instance Nationale de Protection des Données à caractère Personnel (INPDP), the Tunisian data-protection authority.

The Service is not directed to children under 16 (or the minimum age required by applicable law), and we do not knowingly collect their personal data.

We may update this Privacy Policy from time to time. Material changes will be communicated through the Service or by email, and the “Last updated” date above will reflect the latest revision.
