Terms of Service

The Service is operated by BlackYack SUARL, a Tunisian single-member limited liability company (société unipersonnelle à responsabilité limitée) registered with the Registre National des Entreprises (RNE) under unique identifier 1730839M, with its registered office at Avenue Hédi Nouira, 5000 Monastir, Tunisia (operating under the brand “Artwelt”; “BlackYack”, “we”, “us”).

You must be at least 16 years old (or the minimum age required in your jurisdiction) and able to enter into a binding contract. Accounts are created and secured through our authentication provider, Clerk. You are responsible for the activity that occurs under your account and for keeping your credentials secure.

Artwelt lets you generate and edit images and videos using third-party AI models. Use of the Service consumes credits according to our then- current pricing. Credits and plans are billed through Konnect. Unless required by law or stated otherwise, credits are non-refundable and may expire as described at the point of purchase.

• Your inputs. You retain ownership of the prompts and images you submit. You represent that you have the rights necessary to submit them and that doing so does not infringe any third-party rights.
• Your outputs. Subject to these Terms and your compliance with the applicable AI providers’ terms, you own the media you generate, to the extent such ownership is permitted by law.
• Licence to operate. You grant us a limited licence to host, process, and transmit your content solely to provide and improve the Service, including sending it to our AI sub-processors for generation.

You must use the Service lawfully and in accordance with our Content Policy. We may suspend or terminate accounts that violate these Terms or that Policy.

Generation is powered by third-party models hosted by Alibaba Cloud Model Studio (Singapore) and Replicate (United States). Your use of generated outputs is also subject to those providers’ usage terms. Outputs are produced by automated systems and may be inaccurate, unexpected, or unsuitable for a given purpose; you are responsible for reviewing them before use.

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

The Service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your requirements.

To the maximum extent permitted by law, Artwelt shall not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law, including consumer rights.

You may stop using the Service at any time and delete your account from your account settings, which erases your stored media. We may suspend or terminate access for breach of these Terms, suspected abuse, or to comply with the law.

We may modify the Service or these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the Republic of Tunisia, and any dispute is subject to the exclusive jurisdiction of the competent courts of Monastir, Tunisia, without prejudice to mandatory consumer protections in your country of residence.
